Beyond Bradley Manning: The Government Has Made Its Point (UPDATED)

UPDATE (8/21/13): Bradley Manning was sentenced by a military judge today to 35 years in prison. In response, the ACLU’s Ben Wizner said:

When a soldier who shared information with the press and public is punished far more harshly than others who tortured prisoners and killed civilians, something is seriously wrong with our justice system. A legal system that doesn’t distinguish between leaks to the press in the public interest and treason against the nation will not only produce unjust results, but will deprive the public of critical information that is necessary for democratic accountability. This is a sad day for Bradley Manning, but it’s also a sad day for all Americans who depend on brave whistleblowers and a free press for a fully informed public debate.


The piece below was first published as part of the New York Times Room for Debate feature “Beyond Bradley Manning,” which asked: Will the outcome of the Manning trial have ramifications in other cases? How significant is the verdict?

The first thing to be said about Bradley Manning’s trial is that the entire exercise was unnecessary. There was no real factual dispute, since Manning admitted he had leaked the documents to WikiLeaks, and he offered guilty pleas that would have allowed a sentence of up to 20 years.

Did the government think 20 years in prison was an insufficient punishment for Manning? Maybe so.

But the more likely explanation for the government’s refusal of the plea is that it hoped to establish the dangerous precedent that leaks to the press could be equated with “aiding the enemy.” Manning’s acquittal on that charge was a repudiation of the government’s evidence, but not its legal theory, so the government may well take a second bite from that bad apple in a future case.

The government’s theory, in a nutshell, is that posting potentially useful information to the Internet aids the enemy because the enemy has access to the Internet. In its continuing prosecution of the former C.I.A. agent Jeffrey Sterling, accused of sharing classified information with James Risen of The New York Times, the government offered a variant of this argument. It insisted that leaks to the press were even “more pernicious” than real espionage – selling secrets to enemies – because not just one, but “every foreign adversary stood to benefit from the defendant’s unauthorized disclosure.”

The government’s reasoning couldn’t be clearer or more dangerous: it’s preferable for the American people to remain in the dark if that’s what’s necessary to keep the enemy in the dark. But sometimes information that might be useful to an enemy – such as evidence that the United States tortured prisoners in Abu Ghraib and elsewhere – is also indispensable to the public to ensure democratic accountability and adherence to our nation’s ideals.

Equating whistle-blowers with traitors is not only crude, but also fundamentally antidemocratic. And until our laws fairly distinguish between leaks in the public interest and treason against the nation, we shouldn’t be surprised when our whistle-blowers seek asylum elsewhere.

Obama: I Had To Violate The Constitution Because Republicans Are Such Partisan Hacks (Or Something)

During his press conference today, President Obama was asked by Fox News Channel’s Ed Henry about ObamaCare. The President answered the question by saying that it’s the Republicans’ fault that he had to violate the Constitution.

Here is Ed Henry’s very sensible question: “October 1st, you’re going to implement your signature health care law. You recently decided on your own to delay a key part of that. And I wonder, if you pick and choose what parts of the law to implement, couldn’t your successor down the road pick and choose whether they’ll implement your law and keep it in place?”

Mr. Henry also asked about Benghazi, but we’ll leave that for another article. We’ll focus on the President’s answer to the above question here.

Here’s how President Obama started the ObamaCare answer: “I didn’t simply choose to delay this on my own. This was in consultation with businesses all across the country, many of whom are supportive of the Affordable Care Act, but — and who — many of whom, by the way, are already providing health insurance to their employees but were concerned about the operational details of changing their HR operations if they’ve got a lot of employees, which could be costly for them, and them suggesting that there may be easier ways to do this.”

In other words, President Obama consulted with business leaders before he decided to violate the Constitution. He violated the Constitution, of course, by changing the law on his own. He’s not allowed to do that. Congress passed a law that said that the employer mandate will begin on January 1, 2014. President Obama pushed it back one full year without any approval from Congress.

However, the President’s excuse for violating the Constitution gets even better. He blamed Republicans. Here is what he said: “Now what’s true, Ed, is that in a normal political environment, it would have been easier for me to simply call up the speaker and say, you know what? This is a tweak that doesn’t go to the essence of the law. It has to do with, for example, are we able to simplify the attestation of employers as to whether they’re already providing health insurance or not. It looks like there may be some better ways to do this. Let’s make a technical change of the law. That would be the normal thing that I would prefer to do, but we’re not in a normal atmosphere around here when it comes to, quote- unquote, Obamacare.”

So it’s the “political environment” that enabled President Obama to change a law by executive fiat? We must have forgot about that provision in the U.S. Constitution that enables a president to change laws on his own because the “political environment” isn’t favorable to his wishes.

On this point, President Obama concludes: “We did have the executive authority to do so, and we did so. But this doesn’t go to the core of implementation.”

No, he didn’t have the authority to change the law by executive authority. The fact that he even discussed changing it by the normal legislative process if the “political environment” was more favorable demonstrates that even he believed that Congressional involvement was necessary to change the law.

Soooooo, my guess is that most of you are going to say that everything is just peachy and cool, and there is nothing to worry about in and around the DC area, in spite of these warnings coming directly from our government, which, by the way, have NOT been directed at the public! No, they have been directed at foreign powers! You, the public, are being kept in the dark. Do you believe that the DHS is there for our own good, and that people who are concerned about this activity are crazy conspiracy theorists reacting to nothing real except fear itself?

Well, is all of this information just all made up? Why would it be made up? What would be the motivation for all of these independent sources to come up with all of this agreeing information about the despotic and tyrannical actions of the DHS? Wake UP, America!!!

Certain people, in sadly massive numbers, self righteous do-gooders who think themselves spiritually enlightened Christians who have condemned my views and called them “paranoid” falsely believe that we can make evil leave our experience by just leaving it alone. They will soon be facing a reality check. How do you get a handle on ANY kind of evil? By wishing it away and believing that it is not really influencing our experience? You misunderstand the deceptive nature of evil itself. Evil IS deception itself! That is its very definition! “A liar and the father of it”!

The truth is, that if evil is making ANY appearance in your human experience, you as a human being are already its victim, and are living under the influence over which you faslely claim dominion through the action of ignoring it. You are wrong. Evil MUST be exterminated from consciousness before it will or can leave human experience,.

YOU and I are the only ones who can control our own consciousness, and hence govern the experience we consciously live in. You do not live God;s life until you conscioiusly act it out and BE God’s life made manifest. That does not mean looking the other way in the face of evil suggestion. Do you think this is crazy talk? You are sadly mistaken. Do you think I am just a fearful lunatic? Then just wait and see the results of the action of your own thoughts, or the lack of exercise thereof.

It may be a hard lesson for all of humanity – one which it continues to repeat generation after generation. But it does NOT have to be this way! But, you can be sure that that is what mankind will experience for as long as you bury your head in the sand, covering your eyes and ears and mouth chanting “See no evil, hear no evil, speak no evil”.
