Kansas Law Would Make TSA Pat Downs Illegal – And Restrict Search Procedures for Children

It looks as if Kansas legislators have had just about enough of the “security theater” of airport screening by the Transportation Security Administration.

Rep. Brett Hildabrand helped to introduce HB 2175, which would make it illegal for TSA screeners to touch the private parts of passengers, as well as prohibit them from removing those passengers under eighteen years old from under control of their parents or legal guardians.

Twenty other House Republicans are joining him in pushing the bill and this would impact between 100 and 110 TSA officers at seven Kansas airports.

The Shawnee Republican said,

“Air travelers are subjected to aggressive, humiliating pat-downs, many of which would land the average stranger off the street in jail. But because the federal government has given someone a blue uniform and a badge, we are told that person has authority over our bodies and we must endure.”

Hildabrand pointed to the story of a three year old in a wheelchair that was scrutinized by the TSA and wrote:

“This is exactly why we need to pass HB 2175, regulating the TSA conduct in Kansas! This is yet another despicable assault by the TSA”

The TSA claims that the “Supremacy Clause,” found in Article VI of the US Constitution gives the Federal government jurisdiction in this matter and it prevents states from regulating the federal government. That is only in the case where such jurisdiction is Constitutional. The particular clause in question reads:

“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

The TSA blog arguing for the Supremacy Clause read, “We wish we lived in a world where you could just walk on a plane with no security screening, but that just isn’t the case unfortunately. Aviation security agencies worldwide have been using pat-downs long before TSA was created to prevent dangerous items from getting onto airplanes. The pat-down is a highly effective tool to resolve certain alarms and keep these dangerous items off of planes that could cause catastrophic damage.”

Kansas Law Would Make TSA Pat Downs Illegal This is utter nonsense. The Federal government, prior to 9-11 did not engage in this practice. It is one thing for private airport security to engage in it. It is quite another for the Federal government to do it. It is a clear violation of the Fourth Amendment.

Furthermore, TSa is out to keep dangerous items off of planes, or so they say, but it has been demonstrated that many items they seek to keep off planes travel across country. It is also highly documented of their harassment and utter ridiculousness in regards to the porn scanners, testing of your drink for explosives before you board your flight and the silly notion of checking grandmothers and people in wheelchairs, subjecting them to humiliating unlawful and unconstitutional searches and in some cases seizures.

The State of Kansas can remove TSA officers from any and all airports if they so desire. The Federal government does not have the right to violate the Fourth Amendment rights of anyone, including those flying on airplanes.

Second, there is the issue of nullification. That’s right, the Tenth Amendment. While many states are already pushing nullification of the National Defense Authorization Act and Obamacare, Kansas should push the envelope. While I applaud Rep. Hildabrand’s efforts, it doesn’t go far enough. Where in the Constitution does the US Federal government possess the authority to federalize airport security and in the process demand the violation of the Fourth Amendment rights of passengers before they may board an airplane? It isn’t in there.

However, remember it wasn’t long ago that Texas tried a similar move and though there were the votes, the Feds made a threat of shutting down flights in and out of Texas and lawmakers backed off. As long as they will not stand up against tyrants, the tyrants will continue to be bullies. It’s time to actually stand for freedom and throw off the chains of an oppressive Federal government.

Army Job Vacancy: “Internment/Resettlement Specialist” for Indefinite Detention FEMA Camps

Does it concern anyone that indefinite detention,  FEMA camps and now Internment/ Resettlement Specialists are all magically appearing out of nowhere at exactly the same time as the attacks on gun rights and freedom of speech?

I thought we lived in a society where we have Constitutional rights that are protected by restricting the government? Apparently I was mistaken. Currently, we have indefinite detention, FEMA “labor” camps, and a president who won’t even answer “No” to the question “Can you kill Americans on American soil without due process? DHS Supplier Now Offers Realistic Targets Such as Pregnant Women, Young Mothers, Elderly and Children Because Law Enforcement Requests Them

Law Enforcement Targets, Inc., a provider of shooting targets to the Department of Homeland Security, has admitted that targets depicting pregnant women were “requested” by law enforcement agencies.

The story yesterday from www.infowars.com about the targets caused outrage, crashing Law Enforcement Targets, Inc.’s website and leading the company to release a statement on Facebook inviting comment and criticism about the products.

The fact that targets of armed pregnant women, children, mothers in playgrounds, and American gun owners in general are being represented as “non traditional threats” “for the first time” is deeply concerning given the admitted preparations for civil unrest undertaken by Homeland Security as well as other federal agencies.

Currently DHS Is:

  1. the Division of Homeland Security (DHS) has purchased roughly 2 Billion rounds of ammo (enough to shoot every man, woman and child in the USA 6 times) over the past year (In comparison, during the height of active battle operations in Iraq, US soldiers used 5.5 million rounds of ammunition a month.)
  2. and the ammo is hollow-point (not practice) ammo
  3. a supplier to DHS now “for the first time” offers non-standard targets including pregnant women, young children and elderly people because law enforcement officials request them.

The DHS also purchased no less than 7,000 fully automatic assault rifles last September, labeling them “Personal Defense Weapons.” For those unfamiliar, these fully automatics fire like machine guns and are different than the semi-automatics that currently are under attack by legislators. 

Realistic Looking Human Targets Like Children, Mothers, Elderly

Law Enforcement Targets, Inc. is a 21-year designer and full service provider of training targets for the DHS, the Justice Department and thousands of law enforcement agencies throughout the country.

The company’s website offers a line of “No More Hesitation” targets ”designed to give officers the experience of dealing with deadly force shooting scenarios with subjects that are not the norm during training.” The targets are, “meant to help the transition for officers who are faced with these highly unusual targets for the first time.”

Does DHS Have The Right To Target Law Abiding Citizens?

The problem with that question is that the law can suddenly be changed to make peaceful people who have never broken the law suddenly criminals. For instance, if semi-automatic guns were banned suddenly and people were ordered to turn them in, suddenly millions of Americans who have never had any more legal difficulty than a speeding or parking ticket are suddenly classified as criminals.

The Department of Homeland Security operates on US soil. It doesn’t function outside of US boarders. Why would it need 2 Billion rounds of ammo on US soil?

A leaked US Army Military Police training manual for “Civil Disturbance Operations” also outlines how military assets are to be used domestically to quell riots, confiscate firearms and even kill Americans on U.S. soil during mass civil unrest.

People Who Don’t Want to be Stripped of their Rights are Obviously Very, VERY bad people.

The “Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment” document leaked to the alternative media in 2009 set the stage for demonizing gun owners and Second Amendment advocates in addition to a panoply of other political groups derisively tagged as “rightwing extremist” by the government.

The Missouri Information Analysis Center (MIAC) also produced a document in 2009 warning about the danger of a purported “Modern Militia Movement,” including the likes of Ron Paul, Bob Barr and Chuck Baldwin. MIAC and fusion centers around the country coordinated with the DHS to “collect, evaluate, analyze, and disseminate information and intelligence” on the supposed threat of libertarians and constitutionalists, including Second Amendment advocates. Between 2004 and 2007, the DHS provided $254 million to fusion centers engaged in surveilling Americans considered a terrorist threat by the government.

Earlier this year, the DHS released a report, “Hot Spots of Terrorism and Other Crimes in the United States, 1970 to 2008,” that employed the phrase “extreme right-wing, ethno-nationalist/separatist” to describe individuals and groups it claims pose a domestic terrorist threat.

According to the latest DHS report, the new ‘terrorists’ in this country are the Americans who love liberty, hate unconstitutional government edicts and fear the bureaucrats running Washington, D.C.,” writes Pat Shannan. “Second Amendment advocates are at the top of this ‘terrorist’ list, but a mere ‘pro-life’ bumper sticker might be enough to make one suspect in the eyes of a dumbed-down cop who forgot his oath.”
